In these Terms, “we”, “us” and “our” refer to Europa Beauty Supplies Ltd. “You” refers to the person using the website or making a purchase.

1. Scope and consumer protection

Your purchase agreement includes these Terms, the product and order information presented before purchase, and the applicable Return and Refund Policy and Shipping Policy.

Please review this information before submitting an order.

These Terms preserve all rights, legal warranties and remedies that cannot lawfully be excluded or restricted under applicable consumer protection laws. Where a provision conflicts with a mandatory legal requirement, that requirement takes precedence.

If you purchase on behalf of a business, you must have authority to act for that business. Any separately agreed wholesale or commercial terms apply to the transactions they expressly cover. Your status as a consumer is determined by applicable law and the purpose of your purchase.

2. Eligibility and customer information

You must have the legal capacity required under applicable law to enter into a purchase agreement.

Please provide accurate and complete billing, delivery and contact information. If you discover an error after placing an order, contact us promptly so that we can help address it.

If you create an account, take reasonable steps to protect your login credentials and notify us if you suspect unauthorized access. Having an account does not change your statutory consumer rights.

3. Products and instructions for use

Please read the product description, ingredient information, instructions and warnings before purchase and use. Follow the instructions supplied with the product, including any precautions or testing instructions specified on its label.

Products identified as being for professional use must be used in accordance with that designation and the relevant instructions.

Product images are intended to represent the products offered. Screen settings may affect the appearance of colours. Any material product characteristic or variation relevant to your purchase will be disclosed before you order.

These provisions do not reduce our obligations concerning accurate product descriptions, conformity, safety or applicable legal warranties.

4. Prices, currency and promotions

Prices are displayed in the currency identified on the website and at checkout. Please check the currency before submitting your order.

Before you complete your purchase, the order summary will identify:

We will send an order confirmation to the email address you provide. We will also provide a copy of the purchase agreement, including the applicable terms and order information, in a format you can retain and print, within the period required by applicable law.

Please keep this information for your records. If you do not receive your confirmation, contact us.

We may request information reasonably necessary to verify a payment or investigate suspected unauthorized activity, in accordance with applicable privacy and consumer protection laws.

6. Payment

Available payment methods are shown at checkout.

By submitting an order, you authorize payment of the total amount disclosed and agreed at checkout using a payment method you are entitled to use.

Payment authorization and collection will take place in accordance with applicable law, including any provincial restrictions on advance payments.

If a payment fails or cannot be verified, we will contact you where appropriate. Any resulting refusal, suspension or cancellation of an order will be handled only as permitted by law, with any refund due processed within the applicable legal deadline.

Separate terms imposed by your payment provider do not remove your rights against us under applicable law.

7. Availability, errors and changes to an order

We aim to keep product descriptions, prices and stock information accurate. We may correct listings and update availability for future purchases.

If we identify an issue affecting an order already placed, we will contact you promptly and work toward a lawful resolution.

We will not unilaterally increase an agreed price, substitute a different product or treat a pricing error or lack of stock as automatically cancelling an existing purchase agreement.

Any change requiring your agreement will be explained before you decide whether to accept it. Your statutory rights remain available.

8. Shipping and delivery

Available delivery destinations, shipping charges and the delivery date or timeframe applicable to your order will be disclosed before purchase. Additional delivery information is provided in our Shipping Policy.

Please ensure that your delivery address is correct and that any necessary delivery instructions are provided.

If a delivery problem occurs, contact us so that we can investigate and assist. Any additional delivery cost will be charged only where lawfully applicable and disclosed or agreed.

We remain responsible for fulfilling our contractual and legal delivery obligations. Using a carrier does not remove those obligations.

If an event outside our reasonable control affects delivery, we will inform you of the issue and any proposed revised arrangements. Such an event does not automatically remove your statutory cancellation or refund rights or require you to accept an indefinite delay.

9. Returns, refunds and cancellation

Our Return and Refund Policy explains the procedure and conditions for returns, refunds and cancellation requests.

It includes a voluntary return option under which you may request a return within 30 calendar days after delivery, subject to the conditions stated in that policy.

The voluntary return conditions do not limit legal remedies for defective, damaged, incorrect or otherwise non-conforming products, or any statutory cancellation right.

If you wish to cancel an order before dispatch, contact us promptly. We will make reasonable efforts to stop the shipment. This administrative process does not restrict any cancellation right available under applicable law.

Where a statutory cancellation or refund right applies, the applicable legal requirements govern the notice, refund amount, return arrangements, costs and deadlines.

10. Legal warranties and product concerns

Products remain subject to the legal warranties, conditions and guarantees applicable to your purchase.

If a product appears defective, damaged, incorrect or inconsistent with its description, contact us with your order details and a description of the problem. Photographs may help where available.

We will provide the remedy required by applicable law. Depending on the circumstances, this may include repair, replacement, a price reduction or a refund.

A manufacturer's warranty, where offered, is additional to any rights you have against us under applicable law.

11. Website use and intellectual property

You may use the website to obtain product information, compare products, make purchases and manage your orders.

You must not use the website for fraud, unauthorized access, interference with its operation, the distribution of malicious software or other unlawful activity.

The website may occasionally be unavailable because of maintenance or technical issues. Such interruptions do not remove our obligations relating to existing orders.

These Terms preserve liability and remedies that cannot lawfully be excluded or restricted, including applicable product warranties and consumer protection rights.

14. Applicable law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to mandatory laws and consumer protections that apply to your purchase, including those of your province or territory where applicable.

If you have a concern, we encourage you to contact us so that we can try to resolve it.

Contacting us is not a condition for exercising a legal remedy, contacting a regulator or bringing a claim before a court with jurisdiction.

These Terms do not require mandatory arbitration, waive your right to participate in a class proceeding or require you to bring a claim exclusively before an Ontario court where applicable law permits another forum.

15. Updates to these Terms

We may update these Terms for future purchases and will indicate the revision date.

The version applicable when your purchase agreement was formed continues to govern that purchase, unless you agree to a lawful change or applicable law requires otherwise.
